TR CU declaration completion procedure

As prescribed by the Technical Regulations of the Customs Union, products subject to conformity certification must have a TR CU declaration. In this context, unlike a certificate, a declaration is to be completed by the applicant themselves, with the certification authority tasked with its verification and, if successful, entry into the integrated register of issued certificates of conformance and registered declarations of conformity completed on the standard form.

The form of the declaration of conformity and the rules for its completion are approved by Eurasian Economic Commission Panel Decision No. 293 of 25 December 2012, “On common forms of the certificate of conformity and declaration of conformity to the Technical Regulations of the Customs Union and the rules completion”. It is forbidden to use the member states' domestic statutory forms of declaration.

Previously, the requirements for TR CU declaration completion were adopted under Customs Union Commission Resolution No. 896 of 9 December 2011. No declaration may be produced to “old” standards after 1 July 2014, as prescribed in Clause 3 of Resolution No. 293.

A declaration of conformity to the Technical Regulations of the Customs Union is to be produced on a standard sheet of white paper in A4 size (210 x 297 mm). When filling in the declaration, you may not use abbreviations (other than the generally accepted abbreviations of words and terms in the Customs Union) or any corrections.

The declaration is required to give full product details, including:

  • name of product;
  • product identification attributes (type, mark, model, SKU etc.);
  • name of manufacturer;
  • title and reference details of the documents governing the manufacture of products (technical regulation, standards, specifications etc.);
  • CUIMEXCC codes of products;
  • production scale (mass, batch or job production).

In the declaration fields “Compliant with”, list the titles of the Technical Regulations of the Customs Union, GOST standards and other regulations applicable to the products, and in the field “Declaration of conformity made based on”, the numbers of test reports on standard samples and test dates, providing the name and address of the testing laboratory.

In the field “Additional information”, you will normally specify the declaration scheme, as well as the shelf life, service life or best-before date of products (if necessary).

The requisite information about the applicant themselvesis to be given as applicable (incorporated or unincorporated business).

Note that the Customs Union rules stipulate that TR CU declarations, unlike RF TR declarations and GOST R declarations, provide no details of the certification authority (name and address) to have registered the declaration. Also, the certification authority no longer stamps or signs the declaration.

The only details of TR CU declaration registration provided are the following:

  • declaration registration number, generated pursuant to the legislation of the Customs Union member state: No. TS RU/BY/KZ, where TS [CU] is Customs Union, and RU (Russia), BY (Belarus), KZ (Kazakhstan) are the codes of the jurisdictions that registered the declaration;
  • the date of declaration registration in the integrated register of the Customs Union in the following format: day, two Arabic numerals; month, two Arabic numerals; year, four Arabic numerals.

Completion of declaration of product conformity by a sole trader

Where the applicant in the declaration of goods is a sole trader, the declaration of conformity to the technical regulations of the Customs Union shall provide the following information:

  1. Details of public registration.
  2. Location, including domicile.
  3. Contact information (telephone and fax number, email address).

In this context, the highlighted field “as represented by” is thus to be left blank (pursuant to section b), article 4 of the TR CU declaration completion procedure).

The declaration is required to be signed, with the sole trader's initials and surname printed, as well as stamped (if applicable).

Completion of declaration of product conformity by legal entities

Where the applicant in the product declaration is an organisation, the declaration of conformity shall provide the following information about it:

  1. Details of incorporation.
  2. Address, including place of business.
  3. Contact information (telephone and fax number, email address).

It is also required to specify the job title and full name of the CEO of the corporate applicant who makes the declaration of conformity.

The declaration is required to be certified by the applicant's seal and signature, with the name of the CEO of the corporate applicant printed (initials and surname). In this context, the signature may not be stamped.

Note: * - for batch production, list the batch quantity, for job production, serial number. The details of shipping documents are also to be provided.

Completion of appendix

The appendix to the declaration of conformity formsits integral part. An appendix becomes necessary where many details are required in the fields on:

  • products;
  • evidential matter;
  • further details.

Article 5 of the TR CU declaration completion procedure requires that every page of the appendix be numbered, with the declaration registration number specified. It is also required to affix the seal and signature, with the applicant's initials and surname printed.

The TR CU declaration itself shall have a reference to the appendix, with the number of pages specified.
